NVIDIA Settles GTX 970 Memory Lawsuit

NVIDIA has finally settled in the 2015 class-action lawsuit against them for misrepresenting the amount of memory on GeForce GTX 970 graphics cards. NVIDIA has agreed to pay out every buyer of the card $30 USD (per card), and also cover legal fees, which amounts to $1.3 million. It was not specified how much money was set aside for the payout, and whether the payout will only include buyers in the US (as that is as far as the court’s jurisdiction can reach) or the thousands of GTX 970 buyers worldwide.

“The settlement is fair and reasonable and falls within the range of possible approval,” attorneys for the proposed Class said in the filing. “It is the product of extended arms-length negotiations between experienced attorneys familiar with the legal and factual issues of this case and all settlement class members are treated fairly under the terms of the settlement.”

The all stems from the fact that the NVIDIA GeForce GTX 970 did not actually have 4 GB of usable VRAM, but instead only 3.5 GB could be used. NVIDIA advertised the card as having 4 GB of memory.
